Credit Account FAQ

Important information about Freshway Credit Account payment terms, minimum spend, orders, deliveries, returns, cancellations, overdue accounts, warranties, privacy, and account conditions.

What are the payment terms? ×

Approved credit accounts operate on 30-day payment terms. All invoices must be paid within 30 days from the invoice date.

Is there a minimum monthly spend? +

Yes. A minimum monthly spend of $2,000 including GST applies to the credit account. Freshway may review, reduce, or withdraw the credit facility if this minimum is not maintained.

Will my first order be supplied on credit? +

No. The first order will be supplied on a Cash on Delivery basis. Approved credit terms will apply to subsequent orders once the account has been established.

Can Freshway change product prices? +

Orders are charged at the prices shown in Freshway's current price list at the time of ordering. Freshway may increase prices by providing at least 90 days' written notice.

Are freight, GST and other charges included? +

Freight, delivery, GST, taxes, duties, fees and other applicable charges will either be included in the price or separately itemised on the invoice.

When do risk and ownership of the goods transfer? +

Risk passes to the customer when the products are delivered to the nominated location. Ownership remains with Freshway until all amounts owing for the products have been paid in full.

What should I do if products are damaged or defective? +

Please inspect all products after delivery and notify Freshway of any defects or issues within 7 days. If no notice is provided within this period, the products may be treated as accepted.

Can I return products? +

Returns are subject to Freshway approval and applicable law. Approved returns may incur a 20% restocking fee. Return freight is the customer's responsibility unless Freshway is at fault.

Can I cancel an order? +

Standard stocked items may be cancelled within 24 hours of placing the order. Special-order goods, non-stock goods, dispatched goods, and products purchased specifically for the customer's order cannot be cancelled.

What happens if an invoice becomes overdue? +

Overdue amounts accrue interest at 2% per month, calculated daily. Freshway may suspend further deliveries, make all outstanding amounts immediately payable, recover unpaid products, and recover enforcement costs including legal fees.

Can payment be withheld because of a dispute? +

No. The customer may not withhold payment because of a dispute unless Freshway has agreed to this in writing. Both parties must first attempt to resolve disputes in good faith.

Are delivery dates guaranteed? +

No. Delivery dates are estimates only. Freshway will endeavour to meet requested delivery times but is not liable for delays, and a delay does not automatically give the customer the right to cancel or refuse delivery.

What warranties apply to the products? +

Applicable manufacturer warranties apply. To the extent permitted by law, Freshway excludes implied warranties and is not liable for consequential loss. Where liability cannot be excluded, available remedies may be limited to replacement, repair, or reimbursement of the relevant replacement or repair cost.

What happens if supply is affected by events outside Freshway's control? +

Freshway is not liable for failure or delay caused by events outside its reasonable control, including severe weather, natural disasters, industrial action, material shortages, transport delays, equipment failure, or government restrictions.

How can the credit arrangement be terminated? +

Either party may terminate the agreement by providing at least 30 days' written notice. Freshway may also suspend or cancel supply if the customer defaults under the account terms.

How is my personal and business information used? +

Information provided is used to assess, approve, administer, and review the credit account. Freshway may obtain credit reports, verify trade references, conduct company and director searches, and disclose relevant information to credit reporting agencies, government registries, and related entities in accordance with applicable privacy law.

Can I request access to my personal information? +

Yes. You may request access to personal information held by Freshway, subject to applicable law. If required information is not provided, Freshway may be unable to process or approve the credit application.

Which law governs the credit agreement? +

The credit agreement is governed by the laws of New South Wales, and the parties submit to the exclusive jurisdiction of the courts of New South Wales.

Can Freshway amend the account terms? +

Yes. Freshway may amend the terms and conditions by providing the customer with at least 30 days' written notice.

Do you offer free delivery for business accounts? +

Yes. Free delivery is available for eligible B2B commercial and wholesale orders of at least $500 within the Sydney metropolitan area, subject to Freshway's delivery conditions.
